1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and One Brit Abroad ("I," "me," or "my"), concerning your access to and use of my website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
I am registered in the United Kingdom and have my principal place of business in Southeast Asia. By accessing the Site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Professional Services & Engagement
One Brit Abroad provides premium web engineering, software architecture, and digital product design services. Each engagement is governed by a specific Statement of Work (SOW) or Master Services Agreement (MSA) which outlines the scope, deliverables, and timelines.
I reserve the right to refuse service to any individual or entity for any reason at my sole discretion. My services are intended for professional companies and high-growth startups that require enterprise-grade engineering standards.
3. Payment Terms & Staging
To maintain the highest level of engineering focus and resource allocation, I operate on a strict staged payment model for all bespoke projects. Unless otherwise specified in a signed SOW, the following standard payment schedule applies:
- Initial Deposit (50%): Required prior to project commencement. This secures your slot in my development pipeline and covers initial architecture and strategy phases.
- Milestone Payment (25%): Due upon completion of the primary development phase or "Alpha" release, as defined in the project timeline.
- Final Balance (25%): Due upon final approval and prior to the deployment of the production environment or "handover" of source code.
Accepted Payment Methods
I accept payments exclusively through the following channels to ensure security and transparency:
- HSBC UK: Direct bank transfer (BACS/CHAPS/International Wire).
- Cryptocurrency: Major stablecoins (USDC/USDT) or BTC/ETH via verified wallets.
* All payments are non-refundable once work on the respective phase has commenced. Late payments exceeding 7 days will result in immediate suspension of development services.
4. Intellectual Property Rights
Unless otherwise indicated, the Site and my services are my proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by me or licensed to me, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United Kingdom, foreign jurisdictions, and international conventions.
Upon receipt of final payment, I grant you a non-exclusive, non-transferable, perpetual license to use the custom code and assets developed specifically for your project. I retain the right to use non-proprietary components, libraries, and architectural patterns developed during the project for other clients.
5. User Representations
By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.
6. Prohibited Activities
You may not access or use the Site for any purpose other than that for which I make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by me.
As a user of the Site, you agree not to:
- Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from me.
- Trick, defraud, or mislead me and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Circumvent, disable, or otherwise interfere with security-related features of the Site.
- Disparage, tarnish, or otherwise harm, in my opinion, me and/or the Site.
- Use any information obtained from the Site in order to harass, abuse, or harm another person.
- Make improper use of my support services or submit false reports of abuse or misconduct.
7. Project Timelines & Deliverables
I am committed to delivering high-quality engineering within the agreed-upon timelines. However, project schedules are estimates and are subject to change based on client feedback cycles, third-party API availability, and scope adjustments.
Any "Scope Creep" (requests outside the original SOW) will be billed at my standard hourly rate of £150/hr or quoted as a separate milestone.
8. Limitation of Liability
IN NO EVENT WILL I OR MY DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR MY SERVICES, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Governing Law
These Terms and your use of the Site are governed by and construed in accordance with the laws of the United Kingdom applicable to agreements made and to be entirely performed within the United Kingdom, without regard to its conflict of law principles.
10. Modifications and Interruptions
I reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at my sole discretion without notice. However, I have no obligation to update any information on my Site. I also reserve the right to modify or discontinue all or part of the Site without notice at any time.
